Welcome to SHARABUYS ("we," "us," or "our"). By placing an order through our Shopify store, you agree to the terms, conditions, and legal disclaimers outlined below regarding product characteristics, shipping, customs, and liability.

1. Product Authenticity & Handmade Craftsmanship

  • Handmade Variations: The majority of products sold by SHARABUYS—including handmade crafts, cashmere, pashmina, singing bowls, tea, jewelry, and felt goods—are individually handcrafted by artisans in Nepal.

  • Minor Discrepancies: Due to the nature of traditional artisan craftsmanship, minor variations in color, texture, weave, pattern, weight, or dimensions may occur. These variations are not defects but a characteristic of authentic, handmade products.

  • Product Imagery: We strive to display product images as accurately as possible. However, actual colors may vary slightly depending on your monitor settings and lighting conditions.

2. Shipping, Risk of Loss, and Delivery

  • Passage of Risk: All items purchased from SHARABUYS are made pursuant to a shipment contract. Title and risk of loss for all products pass to the customer upon our delivery of the package to the shipping carrier (e.g., DHL, FedEx, USPS, Nepal Post).

  • Delivery Delays: SHARABUYS is not liable for shipping delays caused by carrier delays, severe weather, natural disasters, international customs inspections, or government holds.

  • Customer Address Responsibility: Customers are solely responsible for providing an accurate and complete delivery address at checkout. SHARABUYS is not liable for lost, stolen, or misdelivered shipments resulting from incorrect address inputs by the buyer.

3. International Customs, Import Taxes, and Duties

  • Duty & Tax Responsibilities: For international shipments originating from or delivered outside the seller's primary operating jurisdiction, the buyer is designated as the importer of record.

  • Unpaid Customs Charges: All import duties, value-added taxes (VAT), clearance fees, or tariffs levied by the destination country's customs authority are the sole responsibility of the customer.

  • Refused Shipments: If a shipment is refused or returned to SHARABUYS due to unpaid customs duties or failure to complete customs clearance procedures, the customer remains responsible for all original shipping costs, return shipping fees, and processing fees incurred.

4. Products for Personal Use Only

Unless otherwise agreed to in writing via a formal wholesale agreement with SHARABUYS, all products purchased from our store are intended solely for personal, non-commercial use and may not be resold, modified for resale, or commercially distributed without explicit authorization.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SHARABUYS, its owners, affiliates, and suppliers shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use our products, or from any shipping delays or carrier errors beyond our direct control.
